Terms of Sale and Use

These Terms govern your use of bioantler.com (the "site") and any purchase of BIOANTLER™ products. The site and products are offered by BIOFITNESS LAB™ ("BIOFITNESS LAB," "we," "us"). By using the site or placing an order, you agree to these Terms. Please read them carefully, including the arbitration agreement and class action waiver below.

About the product

BIOANTLER™ is a dietary supplement. It is not a drug, and neither the product nor any statement about it has been reviewed or approved by the FDA. Nothing on the site, the label, our social channels or in our emails is medical advice, and none of it replaces advice from your physician or another qualified healthcare provider.

Product information on the site reflects what we know about the product we sell. Individual experiences vary. Any customer comments or reviews reflect that person's experience only and are not a promise of results.

Safety and use

• For adults 18 and older. Keep out of reach of children.
• Talk to your physician before use if you are pregnant or nursing, take any medication, have a medical condition, or are scheduled for surgery.
• Use only as directed on the label. Do not exceed the suggested use.
• Stop using the product and consult a physician if you experience any adverse reaction.
• If you compete in a sport that tests for banned substances, check with your sport's governing body before using any supplement. We make no representation that the product is permitted in any competition.
• Do not use if the safety seal is broken or missing. Store as directed on the label.

You are responsible for deciding whether the product is right for you. To the fullest extent permitted by law, you use the product at your own risk.

To report a problem with the product, including a suspected adverse reaction, email hi@bioantler.com. If you need urgent care, contact a medical professional or call 911.

Orders, pricing and payment

All prices are in U.S. dollars. Multi-bottle pricing is shown on the site and applied at checkout. Payments are processed by Square, our payment provider; we do not receive or store your full card number. Applicable sales tax and shipping charges are shown at checkout before you pay.

An order is accepted when it ships. We may limit quantities, or refuse or cancel an order, for example if a product is out of stock, a price or description was listed in error, or we suspect fraud or resale. If we cancel an order after you have paid, we will refund you in full.

Shipping

Orders are packed and shipped by our fulfillment partner. Available destinations, shipping methods and costs are shown at checkout. Delivery estimates are not guaranteed. Risk of loss passes to you when the order is delivered to the carrier. If your order arrives damaged or is lost in transit, email hi@bioantler.com and we will make it right.

You are responsible for making sure the product may lawfully be imported into and used where you live.

30-day guarantee

If you are not satisfied with your purchase, contact hi@bioantler.com within 30 days of delivery. We will send return instructions. Send back the product, including any remaining product, and we will refund the purchase price less original shipping charges.

• If we sent the wrong item or a defective item, we will cover return shipping and send a replacement or a full refund, your choice.
• Refunds go back to the original payment method, usually within 10 business days after we receive the return.
• We cannot refund orders that were refused, abandoned, undeliverable because of an incorrect address, or seized by customs, unless the product is returned to us unopened.
• The guarantee applies to purchases made directly from bioantler.com.

Acceptable use

You agree not to misuse the site, including by attempting to disrupt it, gain unauthorized access, place fraudulent orders, or scrape it in a way that burdens our systems.

Intellectual property

BIOANTLER™, BIOFITNESS LAB™ and the stag mark are trademarks of their owner, used under license. The site's content, images and design may not be copied or reused without permission, except for sharing links or brief quotations with attribution.

Third-party services

Checkout, payment and some communications are provided by third parties, including Square. Links to other sites and social platforms, such as Instagram, Threads and Facebook, are provided for convenience. Their own terms and privacy policies apply.

Disclaimers

Except for the 30-day guarantee above, the site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we make no warranty about any health, fitness, performance or other result from using the product.

Limitation of liability

To the fullest extent permitted by law, BIOFITNESS LAB and its owners, affiliates, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of or related to the site or the products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnity

You agree to indemnify and hold BIOFITNESS LAB harmless from claims arising out of your misuse of the site or the products or your breach of these Terms.

Arbitration and class action waiver

Please contact us first at hi@bioantler.com; most concerns can be resolved quickly. If we cannot resolve a dispute informally within 30 days, you and BIOFITNESS LAB agree that any dispute relating to the site, the products or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video or phone, or in New York County, New York, or in the county where you live.

Disputes will be resolved only on an individual basis. You and we each waive any right to bring or take part in a class, collective or representative action or to a jury trial. Either party may instead bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property.

You may opt out of this arbitration agreement by emailing hi@bioantler.com within 30 days of your first purchase or first use of the site, with your name and a statement that you opt out. Opting out does not affect any other part of these Terms.

Governing law

These Terms are governed by the laws of the State of New York and applicable federal law, including the Federal Arbitration Act. Any dispute not subject to arbitration will be resolved in the state or federal courts located in New York County, New York.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the site and your purchases.

Changes and contact
